When family law disputes may not be resolved through negotiation or non-adversarial methods such mediation or the collaborative law process, the judge may determine the outcome. Litigation is the court process where each party has the opportunity to argue his or her position and present evidence, including witnesses, to a judge in support of his or her claims. Based upon the arguments and/or evidence offered to judge by each party, the judge applies the law to the facts of your case to make a determination.
